Terms and Conditions of Purchase

  • Our minimum Layby period is 4 weeks/1 month with a  maximum Layby period of 52 weeks / 12months
  • Our minimum payment is $2.50.
  • We accept payment by Direct Debit and  Mastercard and VISA
  • Regular payments must be made in accordance with your Layby term of weekly, fortnightly or monthly. If you need to change any of your payment details you will need to call our Customer Service Team on 0800 695 292 between 8.30am and 5.00pm Monday to Friday.
  • Your Layby will be delivered to your delivery address within 14 days from final payment date, unless otherwise specified. You can change your delivery address online up to the date specified on your order confirmation. If you wish to change your delivery address within 7 days of final payment date, please contact us on 0800 695 292.
  • Your Layby order can be cancelled at any time up to final payment date. Please refer to my Layby cancellation policy.
  • All prices are in NZ dollars.
When placing an order with  my Layby, you are agreeing to the following Terms and Conditions of Purchase.
Payment start date
Once you have placed your order, payments from your designated account will start on the date you selected.
Payments on Public Holidays
Your Direct Debit, or credit card, payment will come out the working day prior. Please note that we are located in Auckland, therefore we observe Auckland Anniversary. If you wish to skip a payment on a public holiday, or on the day after, you will need to let us know before midday on the working day prior.
Missed Payments
If you miss a payment we will email you an updated payment schedule to reflect either increased payments to cover the missed payment, or a new final payment date.  If you miss three consecutive payments we will cancel your order and email you.  Please refer to my Layby Cancellation Policy.
Direct Debit Authority
By completing your bank account details and placing your order, you are authorising my Layby to debit your payments from your chosen account on the day you have chosen. You can see our full Direct Debit Terms and Conditions here 
Stopping a Direct Debit payment
If you call us on 0800 695 292 by midday the working day before your payment is due we can stop a payment (i.e.before Friday midday for a Monday payment).
How to change your order
You can change your order any time until the Last Change of order date, displayed on your order confirmation email. If you wish to change your delivery address after this date please call our Customer Service team on 0800 695 292.
If your order is cancelled, cancellation charges will apply which enable us to recover our costs.
You may cancel your order at no charge if payments have not commenced.
Once payments have commenced a cancellation fee will be deducted from any refund as follows:
1.     Up to the last date to change your order on the order confirmation, a  cancellation fee of $25 will apply
2.     After the last date to change your order and up to final payment, a cancellation fee of 10% of the payments made to date will apply (The minimum fee payable is $25 and the maximum fee payable is $250).
3.     Your order cannot be cancelled once final payment has been requested
Delivery – General
my Layby delivers across New Zealand via courier.
You will receive a confirmation email with delivery details when you’ve made your final payment. Your order will arrive within 14 days after your final payment clears in our bank account (3 days for Direct Debit, 1 day for credit card after final payment), unless otherwise specified.
While every effort is made to deliver as advised, my Layby cannot accept any liability for delay due to the customer’s failure to complete customer obligations or any other reason beyond the control of my Layby (and/or its staff). my Layby cannot accept any liability resulting from a contracted party’s failure to deliver as advised.  
Delivery - Change of address
You can change your delivery address online up to the date specified on Last Order Change date on your order confirmation. If you need to make changes after this date please contact our Customer Service Team on 0800 695 292.

Sale Prices

Occasionally some items on our website may go on sale for a limited time.  The limited time sale price is for new orders only, not existing orders.  We can only pass on price drops to existing layby's for permanent price drops to a product, not a sale price.

Product Availability

In the event that a product you have ordered becomes out of stock or discontinued by the supplier, my Layby will offer a similar product to the same value and comparable specifications. If the alternative is not suitable, we will offer you a full refund.

Re-order Vouchers

Discount can be applied to full priced items (excludes gift cards, gift vouchers, Apple products, experience vouchers)

No further discount applies to items on sale or in conjunction with any other offer

One discount can be applied per order

Discount is valid for one month from date of issue

Discount can be redeemed on new orders when placed online – simply enter the coupon code at the shopping card

Discount cannot be applied multiple times

We will gladly replace items or reimburse you should a product be damaged in transit and in accordance with our legal responsibilities as a merchant  We are unable to accept returns for other reasons such as if you have changed your mind or have made an incorrect choice about the product and no longer wish to keep it.
There will be no contract between my Layby and a customer until my Layby issues a notice confirming the customer’s order.

Free Gifts
Orders must be fully paid to qualify for free Gift. All eligible free gifts will be delivered once your order has been completed.
